2. Eligibility and User Accounts

MedBrane is primarily intended for medical students and individuals preparing for medical examinations.

By using MedBrane, you confirm that you are legally permitted to use our services.

Users under 18 years of age may use MedBrane only where permitted by applicable law and with the consent and supervision of a parent or legal guardian where required.

  • Use the App only for lawful purposes.

You are responsible for activity conducted through your account to the extent permitted by applicable law.

We may take reasonable security measures, including temporarily restricting access where necessary to prevent unauthorized activity or protect our users.

3. Educational Purpose and Content Accuracy

MedBrane provides educational content intended for academic study, examination preparation, revision, and general medical knowledge development.

Although we make reasonable efforts to maintain accurate and relevant educational materials, we cannot guarantee that every question, answer, explanation, or resource is completely accurate, comprehensive, or current.

Medical knowledge, examination requirements, guidelines, and accepted clinical practices evolve over time.

Therefore:

  • Some educational content may become outdated.
  • Questions and explanations may contain errors or omissions.
  • Content may differ from specific university curricula or examination standards.
  • Different authoritative educational sources may occasionally present different interpretations.
  • Examination performance may vary based on individual preparation and other circumstances.

Users should independently verify important information using recognized medical textbooks, official examination materials, current clinical guidelines, and other authoritative sources.

If you identify an error, please report it to hello@medbrane.com.

We welcome feedback and may correct, revise, or remove educational content when appropriate.

4. Medical Disclaimer

MedBrane is intended exclusively for education and examination preparation. It does not provide professional medical advice, diagnosis, or treatment.

The App is not intended to function as a medical device, clinical decision support system, or substitute for the professional judgment of licensed healthcare practitioners.

Medical cases, clinical scenarios, treatment discussions, medication information, and other health-related content are presented for educational purposes.

You must not use MedBrane as the sole basis for:

  • Diagnosing a medical condition.
  • Selecting or administering treatment.
  • Prescribing or adjusting medications.
  • Making patient care decisions.
  • Managing medical emergencies.
  • Replacing professional medical consultation.

Medical students and healthcare professionals remain responsible for following applicable clinical protocols, institutional requirements, and professional standards.

Always consult qualified healthcare professionals and authoritative clinical resources when making decisions about actual patient care.

If you are experiencing a medical emergency, contact your local emergency services immediately.

5. Examination Preparation and Academic Results

MedBrane may provide questions and resources designed to support preparation for university examinations, the United States Medical Licensing Examination (USMLE), and other medical assessments.

We do not guarantee:

  • Success in any medical school examination.
  • Passing the USMLE or another professional licensing examination.
  • Admission to a particular university or medical program.
  • Any specific score, academic grade, or professional qualification.
  • That questions appearing in MedBrane will appear in official examinations.

Examination standards and requirements are established independently by the relevant institutions and examination authorities.

Users are responsible for consulting official examination information and ensuring that their preparation satisfies the requirements applicable to them.

References to USMLE, specific medical institutions, or examination organizations are descriptive only.

All third-party trademarks and examination names remain the property of their respective owners.

6. User-Generated Content and Community Features

MedBrane may allow users to participate in community forums, publish posts, submit comments, share study resources, or contribute other materials (“User Content”).

You retain ownership of intellectual property rights in original content you create.

By submitting User Content, you grant AlphaBat j.d.o.o. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute within the services, format, and technically adapt your content as reasonably necessary to operate, maintain, moderate, and improve MedBrane.

This license applies only to rights you are legally entitled to grant and does not transfer ownership of your content to MedBrane.

You confirm that:

  • You own your submitted content or have permission to share it.
  • Your content does not violate intellectual property rights.
  • Your submissions comply with applicable laws.
  • Your contributions comply with these Terms and our community guidelines.

Users must accept these Terms or the applicable community policy before submitting User Content.

We may remove or restrict content that violates these Terms, infringes third-party rights, or creates significant safety or legal concerns.

7. Community Guidelines and Prohibited Behavior

MedBrane aims to maintain a safe, professional, and respectful learning environment.

The following activities and content are prohibited:

  • Harassment, bullying, intimidation, threats, or discriminatory conduct.
  • Hate speech or content promoting violence against individuals or groups.
  • Sexually explicit, exploitative, or otherwise unlawful content.
  • Any content involving child sexual abuse or exploitation, including child sexual abuse material (CSAM).
  • Attempts to groom, exploit, or endanger minors.
  • Spam, scams, deceptive advertising, or malicious links.
  • Impersonation or fraudulent representation.
  • Unauthorized sharing of personal or sensitive information.
  • Distribution of malware or attempts to compromise platform security.
  • Copyright infringement or unauthorized distribution of protected educational materials.
  • Encouraging academic dishonesty or distributing confidential examination questions obtained unlawfully.
  • Deliberately spreading dangerous medical misinformation.
  • Providing individualized medical diagnoses or treatment recommendations to other users as a substitute for professional care.
  • Any other activity that violates applicable laws or these Terms.

MedBrane maintains a zero-tolerance policy regarding child sexual abuse and exploitation.

We may immediately remove prohibited content, restrict accounts, and report suspected illegal activity to the relevant authorities where appropriate or legally required.

8. Patient Privacy and Medical Confidentiality

Because MedBrane serves medical students and may host discussions about clinical cases, users must respect patient confidentiality and medical privacy.

You must not upload or share identifiable patient information without a valid legal basis and all required authorizations.

Prohibited disclosures may include:

  • Patient names, contact details, or identification numbers.
  • Medical records containing identifiable personal information.
  • Clinical photographs or medical images that identify individuals without appropriate authorization.
  • Confidential hospital or university documents.
  • Other information protected by applicable medical confidentiality or data protection laws.

When discussing clinical cases, users should use appropriately anonymized information and follow relevant professional and institutional guidelines.

Removing a patient’s name alone may not be sufficient to anonymize clinical information.

Users remain responsible for ensuring that any shared case information complies with applicable confidentiality obligations.

We may remove content that appears to compromise patient privacy or confidentiality.

9. Content Moderation, Reporting, and Blocking

We may review and moderate User Content to maintain community safety and compliance with these Terms.

Moderation actions may include removing content, limiting visibility, issuing warnings, suspending community privileges, or terminating access for serious or repeated violations.

Users may report objectionable content, unlawful material, or inappropriate behavior using reporting tools available within the App or by contacting hello@medbrane.com.

Where blocking functionality is available, users may block accounts to limit unwanted interactions.

Reports should include sufficient details to identify the relevant content or account and explain the alleged violation.

We will review reports and take appropriate, proportionate action based on the circumstances and applicable law.

Users affected by moderation decisions may request a review through hello@medbrane.com.

We do not guarantee that all community content is reviewed before publication.

10. Intellectual Property Rights

The MedBrane name, branding, software, interface, original question banks, educational explanations, graphics, and other proprietary materials are owned by AlphaBat j.d.o.o. or the relevant rights holders.

All applicable intellectual property rights are reserved.

We grant you a limited, non-exclusive, non-transferable license to access and use MedBrane for lawful personal educational purposes, subject to these Terms and applicable mandatory legal rights.

Without authorization, you must not:

  • Reproduce, distribute, or commercially exploit substantial portions of protected MedBrane content.
  • Copy or resell question banks or educational explanations.
  • Use automated tools to scrape or systematically extract substantial portions of the database.
  • Circumvent security systems or payment restrictions.
  • Reverse engineer or modify the App except where permitted by applicable law.
  • Redistribute protected materials as part of competing commercial educational services.
  • Use MedBrane trademarks or branding in misleading or unauthorized ways.

Nothing in these Terms limits applicable copyright exceptions or other mandatory rights.

11. Free Features and In-App Purchases

MedBrane provides educational features that may be available without payment.

Certain additional resources, features, or educational content may be offered through optional in-app purchases.

The availability, price, duration, and conditions of paid features will be presented before purchase.

Purchases may include one-time payments, subscriptions, or other clearly identified arrangements, depending on the products offered.

Purchasing access to digital educational content does not transfer ownership of the underlying intellectual property.

We may adjust the availability or structure of free and paid features, subject to existing purchase commitments and applicable consumer protection laws.

12. Payments and Billing

Purchases made through the Android version of MedBrane may be processed using Google Play Billing.

Where purchases are available through the iOS version, they may be processed using Apple’s App Store payment system.

Such transactions may also be governed by the relevant platform’s payment terms.

Before completing a purchase, users will be shown applicable pricing, billing conditions, and relevant product information.

Prices and taxes may vary according to location, currency, and applicable legal requirements.

We do not guarantee that all payment methods will be available in every country.

If a transaction is unsuccessful, refunded, reversed, or otherwise invalidated, access to the associated paid features may be affected, subject to applicable law.

13. Subscriptions and Cancellation

If MedBrane offers an automatically renewing subscription, the applicable renewal conditions, price, and billing frequency will be disclosed before purchase.

Subscriptions automatically renew unless canceled before the next renewal, according to the conditions presented at checkout.

Google Play subscriptions may be managed or canceled at:

https://play.google.com/store/account/subscriptions

Subscriptions purchased through Apple’s App Store may be managed through the subscription settings associated with the user’s Apple Account.

Canceling a subscription prevents future renewals.

Unless applicable law or the purchase terms provide otherwise, access generally continues until the end of the current paid billing period.

Deleting the App or your MedBrane account does not automatically cancel subscriptions managed by Google Play or Apple.

Users must cancel recurring subscriptions through the relevant payment platform to prevent future billing.

14. Refunds and Consumer Protection

Refund requests for in-app purchases may be submitted through Google Play, Apple’s App Store, or MedBrane support, as appropriate.

Refund eligibility depends on the purchase type, applicable platform policies, relevant circumstances, and consumer protection laws.

Users may have statutory rights concerning defective or non-conforming digital content and services.

Consumers may also have a statutory right to withdraw from certain distance contracts. Any exception for digital content supplied immediately applies only where the legal conditions for that exception have been met, including required consent and acknowledgment.

Nothing in these Terms excludes or limits mandatory consumer rights under applicable Croatian, European Union, or other relevant legislation.

For assistance, contact hello@medbrane.com.

15. Third-Party Services

MedBrane may use third-party providers for authentication, payment processing, analytics, error monitoring, hosting, or other supporting functions.

The use of these services may be subject to their respective terms and privacy policies.

MedBrane may also include links to external medical resources, educational institutions, articles, or other websites.

We do not control all external content and do not guarantee its accuracy, availability, or safety.

Users should independently assess third-party materials before relying on them.

Nothing in this section excludes liability that cannot legally be excluded.

16. Privacy and Personal Data

We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), where applicable.

Our Privacy Policy provides information about the personal data we collect, the purposes of processing, data retention, service providers, security practices, and user rights.

The full Privacy Policy is available at:

privacy@medbrane.com

Medical topics discussed within the App do not authorize users to disclose confidential patient information or other sensitive personal data.

17. Account Deletion and Termination

You may stop using MedBrane at any time.

Users may request account deletion through the App or our online account deletion page.

Online account deletion:

https://medbrane.com/delete-account/

To delete your profile within the App, navigate to your profile settings and select the available account deletion option.

Account deletion may permanently remove associated profile information, saved questions, study progress, achievements, and other account data.

We will delete associated personal data in accordance with applicable data protection laws and Google Play requirements, except where retention is necessary and legally justified.

We may suspend or terminate an account in response to serious or repeated Terms violations, security threats, unlawful activity, or other legitimate reasons, using proportionate measures.

Where appropriate, we may provide an explanation and an opportunity to request a review.

Deleting your MedBrane account does not automatically cancel externally managed subscriptions.

18. Service Availability and Updates

We aim to provide a reliable educational service but cannot guarantee uninterrupted availability.

The App may occasionally be unavailable because of scheduled maintenance, software updates, server issues, connectivity problems, security incidents, or circumstances beyond our reasonable control.

We may release updates that improve functionality, add educational resources, correct errors, or address security concerns.

Certain features may require an internet connection or a supported version of your operating system.

We will comply with applicable obligations relating to the conformity, security, and continuity of digital content and services.

19. Disclaimers and Limitation of Liability

MedBrane is provided for educational purposes.

To the maximum extent permitted by applicable law, we do not guarantee uninterrupted service, error-free educational content, particular academic results, or compatibility with every examination curriculum.

Users are responsible for independently verifying medical information before applying it in clinical, academic, or professional contexts.

We are not responsible for independent statements or medical opinions posted by third-party users, except where applicable law imposes responsibility.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the service.

Nothing in these Terms excludes or restricts liability that cannot legally be excluded, including liability for intentional misconduct or other legally protected claims.

Mandatory consumer rights relating to digital content and services remain unaffected.

20. Changes to These Terms

We may update these Terms to reflect changes in our educational services, business operations, legal obligations, or platform requirements.

The latest version will be published on our website with an updated revision date.

Where material changes affect users, we will provide appropriate notice through the App, website, email, or another suitable communication channel.

Changes affecting existing paid contracts will be implemented only in accordance with applicable law.

Users who do not agree with revised Terms may discontinue using the services and request account deletion.

Any rights relating to existing purchases or subscriptions remain subject to applicable consumer protection requirements.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia, without prejudice to mandatory consumer protection rights applicable in the user’s country of residence.

Nothing in these Terms prevents consumers from exercising their statutory rights or bringing claims before competent courts and authorities.

We encourage users to contact us first when experiencing a dispute or service-related issue.

Written consumer complaints may be submitted by email to hello@medbrane.com or by post to the registered business address provided below.

We will acknowledge receipt of written consumer complaints without undue delay and provide a written response within 15 days of receipt, in accordance with applicable Croatian consumer protection law.

Consumers may also pursue available alternative dispute resolution procedures or other legally established remedies.
